First ICC trial of militia leader Lubanga Dyilo

The International Criminal Court,at the Hague Has started yesterday, the first public trial of Thomas Lubanga Dyilo, the Congolese militia leader for recruiting child soldiers below 15 years of age in the process of continuing the UPC armed conflict with the Congolese administration, without any prejudice to the cause of the armed struggle and engaging them in acts of active hostilities.
The ICC had earlier rejected the pleas of the prosecution due to lack of sufficient evidence and on procedural grounds.Yet the prosecutor of the ICC has succeeded in restoring the trial.At present, 90 survivors are involved and the charges of committing war crimes of recruiting child soldiers have been framed. In DRC, Hema ethnic group of Dyilo is facing ethnic war with other groups.
The first case of the ICC is important in the sense that the ICC is firm on the ground despite negative acts of the USA.Obama has an historical opportunity to bring the USA back to the global rule of law and justice and restore the rightful political space to the USA.India may follow suit in terminating impunity and complying rule of law under the ICC.
For the NE region, Lubanga trial is significant in more than one sense, considering the hard realities of both state and none-state terrorism.The ICC has opened the first leaf of international justice.

a choke- the black history unfolded like a lightning ?], which itself was four seconds later than the 20 January noon that had been stipulated by the 20th Amendment,enhanced global and American expectations while making a turbulent negotiation between hope and possibilities, within opportunities that would be yet constructed.

South Asia, including India, Pakistan and Afghanistan ,naturally falls in his broad worldwide agenda for global wealth creation,considerable job creation for Americans[could be 4 million] including Hindus,Muslims,Jews,non-believers[like us, who are very large in number among scientists and social workers in the USA] and Christians ,who have been assured of a reconstructed economy, roads, bridges, infrastructures , education and restoration of science to its right place. Can his leadership remake America, spoiled by his warmongering predecessor[who also left a note on his table in the best American presidential transitional tradition],restore peace and Palestinians' inalienable right to homeland- considering the recent three -week long Israeli massacre of 1500 Palestininians in Gaza and destructon of half a mllion Gaza homes,do justice to 250 Bush detainees in Guantanamo bay ,within the first few days of his take-over are what the world watchers hang on.

The beauty of his message lies in his promise to make US a friend to every nation -big or small_ [ could be the NE nations also by extrapolation], unlike his other predecessors who divided world into American friends and enemies leaving none in the vast infinite grey space.He even made a modest appeal to the Muslim world for mutual 'interest' and 'trust'without making hatred a populist rhetoric a la Huntingtonian Clash of civilizations that informed his immediate predecessor .Bush's 'axis of evil', scent of McCathysm of 1950s,Dullesian cold war concern are totally absent in both the fervour and tone of Obma approach.This soothing scent reaches out to remote corners and could be a huge asset in strategic re-definition of international relations.

Unlike the young president who drew crowds in 1960s- JFK- who stood in his inaugural address with American friends and against foes in more vitriolic language[ that gained JFK prolonged applause], Obama makes his rhetoric in a postive note of marketing the US as friend of every nation.He is not treading the path of Fukuyama's 'end of history' path .Liberal democracy as Egyptian Shamim Ali says may not be the end of history; Obama has to fight recession like a Roman gladiator[ a new Spartacus of Kanyan breed,Hawai born] .Cautiously, he cited communism just once in reminiscence of cold war,yet communism is alive- may not be Obama's axis of evil.
________In real practice so far, he wished his Republican one time opponent Mc Cain to actively cooperate in reshaping the US with his leadership, took in his one time rival Hillary Clinton in the second most powerful job and addressed his divided American nation in the most bipartisan way ever; he may take even a couple of Republicans in his cabinet posts.A healing America precedes his offically announced agenda of remaking America.

Although he did not mention West Asia at all, which is actually mother of all terrorisms in modern world[ after swearing] starting from 1948 Irgun Jewish terrorism that did real midwifery of the retaliatory AlFatah and others in the Arab world, he did a soft opening to the Muslim world. resolution- the USA,Canada, British models as standard

Apart from military means of settling conflicts or disputes, peaceful methods of conflict resolution had been firmly advanced by the USA,Canada and the UK in the face of armed conflicts that occurred in their territories for formation of new states in the last three decades. Till better methods could be explored in the domain of peaceful conflict resolution, by default- the Western,liberal democratic and parliamentary methods of conflict resolution in situations that India faces in the NE region for more than half a century, is the most viable approach, devoid of all sentimental and imaginary political passions.
___ The USA had Puerto Rico issue and uprisings as well on the same issue and has conducted plebiscites in that territory allowing the people to decide in lieu of the state or the NSA to decide on theiw own.The Puerto Ricans in as many as three plebiscites turned down Puerto Rican independence from the USA.The matter is settled peacefully by the people in that part of the world.
___ Canada already had unquiet Francophone secessionist Quebec.In as many as as three plebiscites conducted in Quebec soil, the Quebecoists turned down Quebec secession from Canada.The matter had been peacefully settled.What future holds for Quebec is not known; even the Candian supreme court unlike its Indian counterpart had gone upto the extent of making a verdict that Quebec has a right to secede from Canada; none but the people has the right to choose their political status.

Indian polity, politics and governance customized fully to the Westerminster model ,in the true sense of the term has yet to look towards as to how Westminster model copes with separatist issues like that of Eire in 1921, ULSTER in 1998, the Welsh nationalism and above all, SNP's relentless demand for revocation of Scotland's merger with England in 1707 with the instrumentality of a treaty of union, comparable in essence to 1826 Yandaboo treaty or Manipur merger agreement, 1949 - in Indian context. How do the parties settle their conflicts is more pertinent than what a PM talks about preponderence of weapons, arms, war- the language of war cry and jingoism.
______ The Scottish secession issue had been tackled by the Whitehall very carefully, even by making a Scottish Tony Blair as PM, subsidizing Scots revenue and enlisting half of the British cabinet from Scotland.The authorhas never heard of half the Indian cabinet filled in by the NE people and he is not going to hear forever.Nor are we going to hear a Nagaor a Boro becoming prime minister of India for leading the Indian nation.Power matters, because it decides the fate and survival of the NE people.

Scottish referenda are a continuing and recurrent political process.Not one referendum draws down the curtain.
a] Opinion polls on the status of Scotland had been held in the years- 1992, 2006 November and 2007 April.In the last two opinion polls, majority of the Englishmen voted that Scotland should leave England and the Scots too voted in that line.
The majority of English people feel that the Scots had taken larger share of the British cake in the name name of unionism. Several polls held in 2007 indicated the same direction.
b] Referenda had been held in Scotland on Scottish issue ,devolution of power etc. in the years- 1970,1973 and also in 1979 and 1997 in a much bigger scale. SNP [ Scottish Nationalist Party] has already decided to conduct one more referendum in 2010 or, not later than in 2011 for the Scottish people to simply say 'yes' or 'No' to a single issue- independence of Scotland from Britain.
The polity is very simple-
the 'consent of the people',' people'- not the army nor the state to decide ' a people's destiny'.Choice is of the people ,not of party or state or the army or some other mythical entities whatsoever.
Historically speaking, Scots like Assamese or, Tripuri or Manipuris[ in plural] had been a nation and they never ceased to be a nation in subsequent political arrrangements whatsoever like the way they are in at the moment subsequently fater three centuries of merger.The problem with the boss or, not -so-people-friendly powers or, elite lies in their own closed mindset that pre-empts the people by falsely assuming that it is 'they', and not the" people" who can or should make a choice for the latter.Things could be alright once the precarious and impaired mindset looks literally towards democratic nuances and mandate.
The war cry from Gandhian India or its Gandhian prime minister makes the spirit of peace uncomfortable in the millieu.Give a chance to peace by resorting to the well established parliamentary methods of peaceful resolution of conflicts as discussed.

Rhetorically speaking, none in human history including Amin,Fuhrer et. al. had ever ceased preaching peace; honest broker and CBMs for triggering off a successful political talk are the only scarce commodities in the jargon-thick politicking process.
__ Certain preliminary issues are not made convincing to all the potential talk partnerships.a] Has the government of India given unambiguous evidence that her talks with the NSCN-IM since 1997 had been fructuous and the tangible results are cropped by the two parties; no sensible group albeit the intelligence- sponsored fungal, mushrooming corporate clubs would blink at the rhetoric.
______b]Has the government of India identified the groups into - those just a few powerful ones which apparently make little compromises with their national sovereignty demands and those which desire better treatment under the present
constitutional dispensation with a minor modification in the constitution .There are a large number of groups like Cobra,ANLNA so and so forth that ask for tribal status, scholarship, fund, reservation etc. of their community and also a large number of unidentified fundamentalist or, state sponsored bodies armed to the teeth.The mess-up in the region is largely due to union government's own deliberate making through its intelligence handiwork.
____About the last mythical category, the author is no longer hypothetical, since a number of recent publications authored by high level RAW/IB officials like Asok Raina,M.K.Dhar,BR Raman,K.Sankaran,general VK.Singh,TI .Sagar and many more have already flooded the international and Indian market.They have revealed a tip of the iceberg that itself is horribale to digest[ some of their revelations would be discussed in course of time, exactly in their own words].In summation of their categorical revelations, the author may state that 95% 0f the insurgent ,militant or terrorist orgs. had been the creation of the Leviathan- the monolithic, inscrutable, invisible state intelligence of one kind or another. This is a mere faithful reporting of their RAW authors' revelations and the the author has no access to the dynamics or equations or their charters.Unlike CIA, the RAW is accountable to nobody in the world .The author does not undermine their political demands either.One can just spend something in book stall and realise the bitter truth,the author has no dispute with truths.
______Whom to talk to and how to talk to is as simple as most perplexing ever.Is there any standard model for such hard talks for political bargaining and negotiations? Probably no- no Da Vinci Code either nor Justinian nor Manuvian nor Confucian.Some of the recent political negotiations like the one facilitated till 2004 by a Nowegian in the Tamil eelam issue broke down ,and the NSCN-IM talk is yet to scratch a preamble stone after 12 x365 days of protracted negotiation. Recent talks bear the best evidence of impasse or,'NO-Talk-at-all' negotiation that might have sent the real signals to the would be partnership.
_______Of talks_ productive and absolutely non-productive, Good Friday Agreement 10 April,1998 is so far the best evidence of a successful political negotiation between the Catholic -based IRA [1968 or, provisional IRA since 1971] and Protestant-based government of Britain. The Anglo-Irish Agreement 1985 did not take off unlike the 1998 agreement which is functional- a bit limping though _ albeit hiccups,made out by the British government vi-a'-vis the institutions carved out of the 1998 Good Friday Agreement.Meaningful peace has been steadily restored in that part of the unquiet world.This agreement could be characterised as 'productive and result-friendly'.The other farcical ones would remain a farce along side the festering political wounds.
_____Strategic analysts,unimpeded and unencumbered by heavy hearts of imaginary national baggages in the mindset, would appreciate the way the 1998 Belfast agreement had been hammered out by the leaderships in partnership.Is it a test case worthy of emulation by the union government? Might be.

Bomb blasts, violence, assasinations happened in Britain as long as the IRA issue had not been resolved by the non-third world leaders.For Scotland referendum to be held in 2010 and Welsh national questions that pose reality in Britain, the author defers opinion in the present piece.They are valid issues undoubtedly.Should the union government follow the parliamentary model of the British government in allowing Scotland to conduct past plebiscites and one more in 2010,the union-NE rebels conflict could be easily resolved by seeking public opinion on a single issue - the referendum.It is an open question.

THE WHOLE PARADIGM:
1] phase one- 1993 declaration by British PM John Major about the outlines of the proposed peace negotiations.
2] phase two- Two framework of negotiations worked out and signed by the two parties in armed conflict.Without a framework, everything is illusory and impossible.
3] phase three- the core and substantive negotiation based on the fulfilment of the first two phases[ for details of Belfast Agreement,1998,pl. see TIME,NY,April 20,1998 and NEWSWEEK issues,among others ].We come directly to the phase three -core negotiation.
### The major metropolitan party- here, the British government of labour party had the political and constitutional strength of holding negotiations of such category.John Major had the will to do ,but had the incapacity to act as his government lacked the two-third majority in the lower house,unlike the Labour prime minister in 1998, who had the constitutional capacity to negotiate and 'act upon the will'.Barring Rajiv government, rest of the governments are either minority or coalition or simple majority governments that is incapabale of reaching out to permanent solutions in the true sense of the term.Rhetoric and capacity are ocean apart in terms of hard result-friendly talks that bear fruits.
### The Belfast paradigm had considered the guaranter as very vital and indispensable for a result-friendly negotiation.The Belfast talk-guaranters had included primarily the US president Bill Clinton and others like-US senate leader George Mitchell, Irish prime minister Arhern,British prime minister. The guaranters not only facilitate the talks,but also prevent the talks from a total breakdown or, even sliding down the abyss or, saving the talks from signing off.
____Diplomats with impaired judgement would not hesitate to sign off a talk in the midway.The guaranter checks the breakdown.The eelam talks had just one facilitator till 2002, and the NSCN-IM talk had neither a facilitator nor the most essential talk component- a guarantor.
### As regards weapon decommissioning, it is made applicable to all the parties in the armed conflict,not merely to the IRA or whatever.Weapon decommissioning of both the parties is the foundation of peace process.In 1964, the Nagaland peace committee led by JP Narain recommended simultaneously the prompt withdrawal of Indian army from Nagaland, and deposit of the rebel weapons .The IRA on this count, wanted to defer the weapon decommissioning till 2000 AD.

The prime minister's 96 Indian Science Congress lecture at Shillong on disarming NE rebels for talks has not transcended the routine generalties and his bonafide intentions to bring just and durable peace could have highlighted the framework of negotiations as much as British PM - his counterpart generously did in 1993 by making official pronouncement of Downing Street Declaration.He has to build up CBMs by concretising the roadmap and defining the parameters without frittreing away to rhetoric and imponderable generalities.
