First ICC trial of militia leader Lubanga Dyilo

The International Criminal Court,at the Hague Has started yesterday, the first public trial of Thomas Lubanga Dyilo, the Congolese militia leader for recruiting child soldiers below 15 years of age in the process of continuing the UPC armed conflict with the Congolese administration, without any prejudice to the cause of the armed struggle and engaging them in acts of active hostilities.


The ICC had earlier rejected the pleas of the prosecution due to lack of sufficient evidence and on procedural grounds.Yet the prosecutor of the ICC has succeeded in restoring the trial.At present, 90 survivors are involved and the charges of committing war crimes of recruiting child soldiers have been framed. In DRC, Hema ethnic group of Dyilo is facing ethnic war with other groups.


The first case of the ICC is important in the sense that the ICC is firm on the ground despite negative acts of the USA.Obama has an historical opportunity to bring the USA back to the global rule of law and justice and restore the rightful political space to the USA.India may follow suit in terminating impunity and complying rule of law under the ICC.


For the NE region, Lubanga trial is significant in more than one sense, considering the hard realities of both state and none-state terrorism.The ICC has opened the first leaf of international justice.
